Platform Usage Agreement

These Terms and Conditions govern the use of the FreshZed platform by customers, riders, and partners. By using FreshZed, you agree to the terms below.

1. About FreshZed

FreshZed is a delivery platform that connects businesses with fresh produce suppliers and independent delivery riders. FreshZed facilitates ordering, payment processing, delivery coordination, and support but does not own or operate farms or shops.

2. Customer Accounts (Hotels and Businesses)

Eligibility

FreshZed is available to registered businesses only. Individual consumer use is not supported at this stage.

Account Responsibility

You are responsible for:

  • Keeping your login details secure
  • Ensuring order details are accurate
  • Confirming delivery locations and contact numbers

FreshZed is not responsible for delays or issues caused by incorrect information provided by the customer.

3. Ordering and Pricing

Item Pricing

Item prices include a small service uplift applied by FreshZed. This uplift helps cover:

  • Platform operating costs
  • Payment processing fees
  • Customer support
  • System maintenance

Platform Fee

Each order includes a flat platform service fee. This fee supports:

  • Platform availability
  • Order management systems
  • Dispute handling
  • Ongoing development
Note: The platform fee is clearly shown at checkout and is non-refundable once an order is confirmed.

Delivery Fees

Delivery fees are calculated based on:

  • Distance between supplier and delivery location
  • Total weight of the order
  • A base delivery charge

Longer or heavier deliveries cost more due to increased rider effort and fuel usage.

Distance Limits

  • Orders within the standard delivery radius are accepted automatically
  • Orders beyond the soft distance limit may incur higher delivery fees
  • Orders beyond the hard distance limit may require manual approval or be declined

These limits protect delivery reliability and rider availability.

4. Payment Terms

Customer Payments

Customers pay FreshZed directly through supported payment methods, including mobile money and bank transfers where available.

Payment Timing

Orders must be paid before delivery is completed unless explicitly agreed otherwise.

Payment Processing

FreshZed uses third-party payment processors. While we aim for reliability, FreshZed is not responsible for outages or delays caused by payment providers.

5. Rider Payments

Rider Status

Riders are independent contractors, not employees of FreshZed.

Rider Earnings

Rider payouts are calculated using:

  • A base delivery fee
  • Distance travelled
  • Total order weight

This ensures fair compensation for both short and long deliveries.

Proof of Delivery

Riders must upload proof of delivery for payment to be released.

Payment Release

Rider payments are released only after:

  • Successful delivery
  • Proof of delivery confirmation
  • Order status marked as completed

Payments are sent to the rider's registered mobile money number.

6. Order Changes, Cancellations, and Refunds

Before Shopping Begins

Orders cancelled before shopping begins may qualify for a full refund.

After Shopping or Delivery Starts

If shopping or delivery has begun:

  • Item refunds may be limited
  • Platform and delivery fees may be retained
  • Rider compensation may still apply

Each case is reviewed individually.

Failed Deliveries

If a delivery fails due to customer unavailability or incorrect details, delivery fees may still apply.

7. Platform Responsibilities

FreshZed aims to:

  • Display accurate pricing
  • Coordinate reliable delivery
  • Support fair treatment of riders and customers
However, FreshZed does not guarantee:
  • Exact delivery times
  • Product availability in all cases
  • Zero delays due to weather, traffic, or supplier issues

8. User Conduct

Users must not:

  • Abuse staff, riders, or suppliers
  • Use the platform for unlawful activity
  • Attempt to bypass payment systems
  • Manipulate pricing or delivery data

Accounts may be suspended or terminated if misuse is detected.

9. Limitation of Liability

FreshZed is not liable for:

  • Indirect or consequential losses
  • Loss of business profits
  • Delays beyond reasonable control

Our liability is limited to the value of the affected order.

10. Data and Privacy

FreshZed collects and stores data necessary to operate the platform, including:

  • Account details
  • Order history
  • Delivery records

Data is handled in line with applicable data protection laws.

11. Changes to Terms

FreshZed may update these terms from time to time. Continued use of the platform constitutes acceptance of updated terms.

12. Governing Law

These terms are governed by the laws of Zambia.
